Italian Supreme Court Upholds House Arrest for Mother Accused of Infanticide

The Italian Supreme Court has reaffirmed its decision to place Chiara Petrolini, a 22-year-old woman from Vignale di Traversetolo, under house arrest. Petrolini faces charges of murder and concealment of corpses following the discovery of her two newborns' bodies, whom she allegedly gave birth to at home and then buried in the garden of the family residence. The court's ruling emphasizes that the circumstances leading to the alleged crimes are no longer present and are unlikely to recur.

In a detailed 14-page document, the judges of the Supreme Court's first penal section outlined their reasoning for upholding the house arrest decision. They acknowledged Petrolini's 'exceptionally high manipulative ability and an uncommon criminal determination.' However, they also noted that the conditions under which the crimes were committed were unique and not repeatable, especially under the constraints of house arrest.

The court's decision overturns a previous ruling by the Bologna Review Court, which, following an appeal by the Parma Prosecutor's Office, had ordered Petrolini to be held in prison instead of under house arrest. The Supreme Court has remanded the case back to the Review Court for a new judgment, leaving the final decision on Petrolini's custody pending.

This case has sparked a debate on the balance between the severity of the charges and the conditions of detention. The Supreme Court's decision highlights the legal principle that detention measures must be proportionate and consider the current circumstances of the accused, rather than solely the gravity of the alleged offenses.
